The body of 14-year-old Caroline Glachan was discovered on the banks of the River Leven in Renton on 25 August 1996.
It wasn’t until 2023, nearly three decades later, that justice was finally served. Three individuals, Robert O’Brien, Donna Marie Brand, and Andrew Kelly, were found guilty of her murder and sentenced to life in prison.
The court heard that O’Brien, 45, and Kelly, 44, brutally attacked Caroline, repeatedly punching and kicking her before striking her with bricks or similar objects, causing severe blunt force trauma to her head and body. Although Brand, 44, did not take part in the physical assault, she was held accountable for leaving Caroline face down in the river, contributing to her death.
Tragically, Caroline was still alive when she was thrown into the water on what was her mother’s 40th birthday. She ultimately died from drowning.
The case remained unsolved for over two decades until Police Scotland’s Major Investigation Team reopened it in 2019, re-examining evidence and re-interviewing witnesses who had lived near the suspects on the night of the murder.
At the time of the murder, neighbors recalled that Kelly and O’Brien had been babysitting two young boys, four-year-old Archie Wilson and his brother Jamie, who accompanied them when they went out that night.
Shockingly, young Archie had witnessed the brutal attack on Caroline and later told his mother about it. He remembered seeing a fight and even described the moment Caroline fell into the river.
His chilling testimony, which resurfaced in the BBC documentary Murder Trial: The Girl in the River, played a crucial role in finally convicting her killers.
“She got hit with a metal pole because there was metal in her eye. I saw it,” Archie said at the time. “I closed my eyes when the metal was in her eyes and when she got pushed into the water.”
However, back in 1996, his account was dismissed due to his young age. Decades later, it would help confirm what other witnesses had said, ultimately bringing justice for Caroline.
Lead prosecution lawyer Alex Prentice KC addressed concerns about relying on the testimony of a four-year-old in a murder trial, stating:
“It is of course a concern that a very young boy is giving evidence in a murder trial, and some people might think that a four-year-old boy is not someone who can be relied upon.
“Archie talks about Caroline getting metal in her eye and an injury being caused. We heard from the pathologist who illustrated to the jury that there was such an injury.
“The question would be, ‘How would he know that?'”
Ultimately, the evidence helped secure convictions. O’Brien was sentenced to a minimum of 22 years behind bars, while Kelly and Brand received 18 and 17 years, respectively.
